• Attendance or participation in any trips, events, or activities organized by Storm Adventures for Tourism, whether for a fee, free of charge, by invitation, or as a guest or companion, shall constitute explicit and final acceptance of all terms and conditions and liability and risk waivers approved by the Company, without the need for electronic or written signature.
• The participant acknowledges that mere presence at the trip or event location or participation in any of its activities constitutes a legally binding acceptance, and no claim of lack of review, lack of signature, lack of understanding, or ignorance of these terms shall be considered.
• The participant acknowledges that, by the nature of tourism and adventure activities and what is customarily recognized legally and practically in this field, it is assumed that the participant has reviewed the Company’s policies, terms, and risk waivers in advance, and that the existence of such terms is natural and does not require special notice or a separate signature.
• The participant acknowledges full awareness that transportation to and from trip locations is conducted using four-wheel-drive vehicles or designated transportation means, which inherently involves potential risks, including bodily injury, accidents, mechanical failures, environmental conditions, or damage to property.
• The participant acknowledges that tourism and adventure activities inherently involve foreseeable and unforeseeable risks, whether direct or indirect, including but not limited to slips, falls, collisions, scratches, minor or severe bodily injuries, psychological harm, or material damage.
• Participation in all activities is entirely at the participant’s own risk, and the participant bears full responsibility for all risks arising from participation, with no right to claim, demand, or compensation from the Company.
• The participant hereby fully and irrevocably releases Storm Adventures for Tourism from any legal, civil, criminal, or compensatory liability for any injury, damage, loss, or harm, whether material or moral, that may occur to the participant or their property during or as a result of participation.
• This release includes the Company’s owners, directors, employees, guides, representatives, partners, contractors, and activity coordinators, and the participant expressly waives any right to claim or litigate against them.
• If the participant drives any vehicle during the trip, the participant undertakes to hold a valid driving license and assumes full responsibility for driving, accidents, traffic violations, injuries, and damages to self, others, or property.
• If passengers are present in the participant’s vehicle, the participant shall be fully responsible for their safety and for any bodily injuries or property damage they may sustain.
• The participant declares being physically and mentally fit to participate and not suffering from any condition that prevents participation, bears all costs of medical treatment, emergency care, or medical transportation if needed, and agrees to receive emergency medical assistance at their own expense when necessary.
• Participation of minors shall be entirely under the responsibility of their legal guardians, and invitations, complimentary participation, or non-payment shall not create any additional liability on the Company nor constitute a waiver of any of its rights.
• The participant undertakes to carry valid identification during the trip, and health insurance where available, and bears responsibility for the absence thereof.
• The participant bears full responsibility for personal belongings throughout the trip, and the Company shall not be liable for loss, damage, or forgetting of personal property.
• Decisions of the trip leader, guide, or Company representative shall be final and binding, and the Company reserves the right to exclude any participant immediately and without prior notice in case of violation of instructions, endangerment of safety, or inappropriate behavior, without any obligation of refund or compensation.
• Any conduct contrary to the laws and regulations of the Kingdom of Saudi Arabia or public morals is strictly prohibited, including possession or use of alcohol, drugs, prohibited substances, or weapons, and the participant bears full legal responsibility for any consequences arising therefrom.
• The participant acknowledges that weather and environmental conditions are beyond the Company’s control, and the Company reserves the right to modify, change, shorten, or cancel the program, route, or schedule whenever deemed necessary for safety or operational reasons, without any obligation of compensation.
• The participant acknowledges that meeting and departure times are mandatory, and any delay or failure to comply may result in missing the trip or part thereof, without any right to refund or compensation.
• The participant acknowledges that the Company does not guarantee that the experience will meet personal expectations or match promotional materials, and no claim or compensation shall arise from any difference in experience.
• The participant agrees to being photographed or recorded during the trip and to the use of photos, videos, or related content for documentation, marketing, or media purposes without any financial rights or future claims, and undertakes not to photograph others without their explicit consent.
• The participant acknowledges that any content provided to or published through the Company’s platforms may be used or republished without any future claim.
• The participant acknowledges and agrees that all digital versions of these terms and conditions, including those published on the website, available via QR code, or sent via email, text messages, or messaging applications, constitute official and legally binding versions with the same legal force as printed copies.
• The participant undertakes not to misuse these terms and conditions or submit malicious claims, misleading information, or false reports with the intent to harm the Company or its reputation, and bears full legal responsibility for any direct or indirect damages resulting therefrom.
• The participant expressly waives the right to file any lawsuit, complaint, or claim against the Company and undertakes to indemnify the Company for any losses, claims, fines, or legal costs, including attorneys’ fees, arising from violation of these terms or the participant’s actions.
• If any provision of these terms is deemed invalid or unenforceable for any reason, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
• These terms and conditions shall be governed by the laws of the Kingdom of Saudi Arabia, the Arabic language shall be the governing language for interpretation, and the courts of the Kingdom shall have exclusive jurisdiction over any dispute.
• The participant hereby confirms that they have read, understood, and agreed to all of the above and accepts full legal responsibility for participation under any capacity whatsoever, whether paid or unpaid, by invitation or otherwise, regardless of the existence of a signature.
Cancellation and Refund Policy
• If a trip cancellation request is made more than seven (7) days prior to the scheduled departure date, the cancellation shall be accepted and the full amount paid shall be refunded without any fees.
• If a trip cancellation request is made more than three (3) days and up to seven (7) days prior to the scheduled departure date, the cancellation shall be accepted and the amount paid shall be converted into a credit that may be used for future trips within the same season.
• If a trip cancellation request is made less than three (3) days prior to the scheduled departure date, a penalty of one hundred percent (100%) of the trip value shall apply, and no refund or compensation shall be due.
• If the trip is canceled by the organizing entity (Storm Adventures for Tourism) for operational reasons, the full amount paid shall be refunded to the participant.
• If the trip is canceled due to circumstances beyond the organizer’s control, such as weather conditions, natural disasters, official decisions, or force majeure, the participant shall be contacted promptly and given the option of rescheduling for a similar trip or service or receiving a full refund, with no further obligation.
• This cancellation and refund policy applies to all participants, whether participation is paid, unpaid, or by invitation, and no rights shall arise beyond what is expressly stated herein.
